Terms of Use

These Terms of Use ("Terms") govern your access to and use of i-wanna-rock.com (the "Site") and the music lesson booking, scheduling, and payment services offered by Wes Davis' "I Wanna Rock" School of Music ("we," "us," "the School"), based in Eureka, California. By using the Site, creating an account, booking a lesson or class, or making a payment, you agree to these Terms.

1. Who we are

The School provides private, one-on-one music instruction (online, in-studio, and in-home) and group classes, primarily serving Humboldt, Mendocino, and Del Norte counties in California, with online lessons available anywhere. The Site lets prospective and enrolled students create an account, browse available lesson times, book and pay for lessons or classes, and manage their schedule and payment history.

2. Accounts

  • You must provide accurate, current information when creating an account (name, email, and phone number).
  • If a student is a minor, the account must be created and controlled by a parent or legal guardian, who is responsible for the account, all bookings made through it, and all payments due. By creating an account for a minor student, that adult confirms they have the legal authority to agree to these Terms on the student's behalf, and to the Liability Waiver and Studio Policy for any in-person session.
  • You are responsible for keeping your password confidential and for all activity under your account. Notify us promptly at info@i-wanna-rock.com if you suspect unauthorized use.
  • We may suspend or terminate an account for violation of these Terms, non-payment, or abusive conduct toward staff or other students.

3. Booking lessons and classes

  • The self-service calendar shows the instructor's actual open availability at the time you view it. Slots can be booked by other students between when you view the calendar and when you complete a booking; we will notify you and offer to reschedule if that happens.
  • Private lessons are booked in 1-hour increments and may be combined up to 4 consecutive hours in a single booking.
  • The price you see is the whole price. Pricing shown at the time of booking (by lesson type — online, studio, or in-home) is the full amount you will be charged for that booking. We do not add booking fees, service fees, processing fees, registration fees, materials fees, or travel surcharges on top of an advertised price. If a price is ever going to include something extra, it will be in the number before you agree to it. Group class pricing is set per class and may include a discount, which is shown before you pay.
  • A booking is not guaranteed confirmed/reserved with priority over other students until payment is made or, where allowed, a payment is reported and later confirmed by staff.

4. Payments

  • We accept payment via PayPal ("Pay Now"), Venmo, and, for staff-arranged billing, cash or check. We do not add a surcharge for paying by card — the price is the same however you pay.
  • PayPal payments are processed immediately by PayPal and are recorded as confirmed automatically. Venmo payments are self-reported by you in the app and are marked "pending" until staff confirm the transfer arrived — please allow up to one business day for confirmation.
  • We do not store your credit card, debit card, or bank account numbers. Card and bank details are handled entirely by PayPal and are subject to PayPal's own terms and privacy policy. Venmo transfers are handled by Venmo/PayPal, Inc. under its own terms.

5. Cancellations, no-shows, and refunds

Cancellation windows, no-show handling, and refund eligibility are set out in full in our Refund & Cancellation Policy, which is part of these Terms.

6. Conduct

You agree not to: use the Site for any unlawful purpose; attempt to interfere with, probe, or bypass the Site's security, rate limits, or booking logic; submit false information in a booking, inquiry, or payment report; or harass or threaten staff, instructors, or other students.

7. Intellectual property

The Site's design, text, graphics, and the "I Wanna Rock" name and logo are owned by the School or its licensors and may not be copied or reused without written permission. Instructional materials provided during lessons are for your personal, non-commercial use.

8. Third-party services

The Site uses third-party services to operate, including PayPal and Venmo (payments), an email provider and Twilio (booking and account notifications by email and text), our web host (which stores the Site and its database), Cloudflare (security and performance), Google Fonts (typography), and Groq (the "Axel" AI chat assistant). These providers process limited data as described in our Privacy Policy and operate under their own terms.

9. Disclaimers

The Site and its booking/availability information are provided "as is." While we work to keep the calendar accurate, we do not guarantee it will always be error-free, uninterrupted, or perfectly in sync with what staff have manually scheduled. Music instruction outcomes (skill progress, performance results) are not guaranteed.

10. Recording, photography, and promotional use

Lessons are often taught over video, and phones record easily, so it is worth being explicit. The Site has no recording feature — nothing in your account records, uploads, or stores audio or video. These rules govern recording made by you or by the instructor during a lesson.

  • Nobody records without everyone agreeing first. California law generally requires the consent of every participant before a private conversation is recorded. Neither you nor the instructor may record a lesson — audio or video, online or in person — unless everyone taking part has been told and has agreed in advance.
  • For a student under 18, the parent or legal guardian gives or withholds that consent, not the student.
  • Practice recordings are welcome, with a heads-up. Recording part of a lesson so a student can practise against it is normal and encouraged — just ask the instructor first. A recording made for practice is for the student’s own personal use. Please do not publish it, post it to social media, or share it beyond the household without the instructor’s written permission.
  • Consent can be withdrawn. You may withdraw agreement to be recorded at any time, and recording stops from that point.
  • Marketing is always a separate, opt-in decision. We will not use a student’s image, name, voice, or playing in any promotional material — website, social media, print, or advertising — without asking for separate written permission first. For a student under 18 that permission must come from a parent or legal guardian. Saying no is always fine, costs you nothing, and has no effect on lessons or scheduling. If you previously said yes you can change your mind: email us and we will stop using the material in anything we publish going forward.

11. Limitation of liability

To the fullest extent permitted by California law, the School is not liable for indirect, incidental, or consequential damages arising from your use of the Site or its booking/payment features. Our total liability for any claim relating to the Site is limited to the amount you paid us in the 12 months before the claim arose. This section does not limit liability that cannot be limited under California law.

12. In-person lessons — see the Liability Waiver and Studio Policy

If you attend an in-studio or in-home lesson, additional terms — including assumption of risk and a liability waiver — apply and are set out in our Liability Waiver & Assumption of Risk, which is part of these Terms for any in-person session. Our Studio Policy covers how in-person lessons actually run — arrival and pick-up for students under 18, supervision, illness, and conduct — and is also part of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above will reflect the latest revision. Continued use of the Site after a change constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Humboldt County, California, unless otherwise required by law.

15. If part of these Terms doesn't hold up

If a court finds any provision of these Terms, or of the documents that form part of them, to go further than California law allows, that provision is to be narrowed to what the law does permit — or removed if it cannot be narrowed — and everything else remains in force. We would rather a single clause fail than have a whole agreement collapse because one sentence reached too far.
